I think the death penalty should stay in place simply because some people deserve to have their lives taken (normally under the circumstance that they've taken someone else's life). In my opinion the death penalty is less about being a deterrent and more about serving justice. For example if I were a criminal (say a serial killer), my two biggest fears after being caught would be: 1. Spending life in jail. 2. Being tortured. The death penalty (depending on whatever method the kill is carried out) is an easy way out.
